Below are the main obligations regarding cookies, such as: informing users of the website about the types of cookies used, their purposes, user consent, ways to request consent, legal notice, cookie policy, etc.

1. Concept of Cookies

Cookies are files stored on the user's computer while browsing the Internet. In particular, they contain a number that uniquely identifies the user's computer, even if it changes location or IP address.

Cookies are installed during Internet browsing, either by the websites visited by the user or by third parties associated with the website. They allow the website to track the user's activity on the same site or others with which it is related. This includes information such as the user's location, connection time, accessing device (fixed or mobile), operating system and browser used, most visited pages, number of clicks, and data about the user's behavior on the Internet.

The website can be accessed without the need for cookies to be enabled, but disabling them may affect its proper functioning.

2. Types of Cookies

2.1. Types of Existing Cookies

Cookies can be classified based on the entity that manages them, their duration on the terminal equipment, and their purpose.

The main obligation for companies or service providers in the information society or the internet, through means such as websites, platforms, or software applications, is established by Article 22.2 of the LSSI, which states:

"Service providers may use data storage and retrieval devices on end-user terminal equipment, provided that they have given their consent after being provided with clear and comprehensive information about their use, in particular, regarding the purposes of data processing (...)."

Similarly, cookies used for the following purposes are exempt from the obligations established in Article 22.2 of the LSSI:

  • Only allow communication between the user's equipment and the network.
  • Strictly provide a service explicitly requested by the user.

In this sense, cookies that would be exempt from the obligations established in Article 22.2 are those with the following purposes:

  • User input cookies.
  • User authentication or identification cookies (only session cookies).
  • User security cookies (incorrect and repeated login attempts).
  • Session cookies for multimedia player.
  • Session cookies for load balancing.
  • User interface customization cookies.
  • Plug-in cookies for sharing social content.

These cookies are excluded from the scope of Article 22.2 of the LSSI, and therefore, it would not be necessary to inform or obtain consent for their use. On the contrary, it would be necessary to inform and obtain consent for the installation and use of any other type of cookies, both first and third-party, session or persistent, subject to the scope of Article 22.2 of the LSSI, for which the guidelines in this document would be useful.

Cookies can be classified based on the entity that manages them:

      • First-party cookies: These are sent to the user's terminal equipment from a device or domain managed by the site's owner and from which the requested service is provided.
      • Third-party cookies: These are sent to the user's terminal equipment from a device or domain that is not managed by the site's owner but by another entity that processes data obtained through cookies.

Cookies, based on the duration they remain active on the terminal equipment, can be categorized as:

      • Session cookies: These are designed to collect and store data while the user accesses a web page.
      • Persistent cookies: These are cookies in which data remains stored on the terminal and can be accessed and processed for a period defined by the cookie's controller, which can range from minutes to several years.

Cookies, based on their purpose, can be:

      • Technical cookies: These allow users to navigate a website, platform, or application and use different options or services available, such as controlling traffic and data communication, identifying sessions, accessing restricted access sections, remembering items in a shopping cart, processing orders, submitting registration requests, or participating in events, using security elements during navigation, storing content for video or audio streaming, or sharing content via social media.
      • Personalization cookies: These allow users to access a service with predefined general characteristics based on criteria on the user's terminal, such as language, the type of browser used to access the service, regional settings from where the service is accessed, etc.
      • Analytics cookies: These allow the controller to track and analyze user behavior on the websites they are linked to. The information collected through these cookies is used to measure the activity of websites, applications, or platforms and create user navigation profiles, with the aim of making improvements based on the analysis of user data usage.
      • Advertising cookies: These enable the most efficient management of advertising spaces, if applicable, that the site owner has included on a website, application, or platform from which the requested service is provided, based on criteria such as the content edited or the frequency with which ads are displayed.
      • Behavioral advertising cookies: These enable the most efficient management of advertising spaces, if applicable, that the site owner has included on a website, application, or platform from which the requested service is provided. These cookies store information about user behavior obtained through continuous observation of their browsing habits, allowing the development of specific profiles for displaying ads based on that behavior.

    • 3. Information about Legal Obligations in the Use of Cookies

Legal obligations imposed by regulations are twofold: the duty of information and obtaining consent.

First, you must identify the cookies being installed or used, analyze whether they are first-party or third-party cookies, session or permanent cookies, and specify their function to determine whether they fall within the scope of Article 22.2.

The second paragraph of Article 22 of the LSSI establishes that clear and complete information must be provided to users about the use of data storage and retrieval devices, especially regarding the purposes of data processing, in accordance with the provisions of Organic Law 3/2018, of December 5, on Personal Data Protection and Digital Rights Guarantee.

Therefore, the information about cookies provided when requesting consent must be sufficiently comprehensive to allow users to understand the purposes for which they were installed and the uses they will be put to.

If a user consents to the use of cookies, information on how to revoke consent and delete cookies must be readily and permanently available to them.

Mandatory information can be provided through multiple methods. As we will see later, these means will not only provide the necessary information but may also request the user's consent for the installation of these devices.

Among the most common methods are:

      • Providing information through a header bar or in the footer, visibly enough.

      • When signing up for a service or before downloading a service or application, this information may be provided along with the privacy policy or in the terms and conditions of service use.

Similarly, information on how to disable or delete the cookies mentioned should be offered through the functionalities provided by the publisher, as well as the method for revoking previously given consent.
