Similarly, cookies used for the following purposes are exempt from the obligations established in Article 22.2 of the LSSI:

  • Only allow communication between the user's equipment and the network.
  • Strictly provide a service explicitly requested by the user.

In this sense, cookies that would be exempt from the obligations established in Article 22.2 are those with the following purposes:

  • User input cookies.
  • User authentication or identification cookies (only session cookies).
  • User security cookies (incorrect and repeated login attempts).
  • Session cookies for multimedia player.
  • Session cookies for load balancing.
  • User interface customization cookies.
  • Plug-in cookies for sharing social content.

These cookies are excluded from the scope of Article 22.2 of the LSSI, and therefore, it would not be necessary to inform or obtain consent for their use. On the contrary, it would be necessary to inform and obtain consent for the installation and use of any other type of cookies, both first and third-party, session or persistent, subject to the scope of Article 22.2 of the LSSI, for which the guidelines in this document would be useful.

      • Personalization cookies: These allow users to access a service with predefined general characteristics based on criteria on the user's terminal, such as language, the type of browser used to access the service, regional settings from where the service is accessed, etc.
      • Analytics cookies: These allow the controller to track and analyze user behavior on the websites they are linked to. The information collected through these cookies is used to measure the activity of websites, applications, or platforms and create user navigation profiles, with the aim of making improvements based on the analysis of user data usage.
      • Advertising cookies: These enable the most efficient management of advertising spaces, if applicable, that the site owner has included on a website, application, or platform from which the requested service is provided, based on criteria such as the content edited or the frequency with which ads are displayed.
      • Behavioral advertising cookies: These enable the most efficient management of advertising spaces, if applicable, that the site owner has included on a website, application, or platform from which the requested service is provided. These cookies store information about user behavior obtained through continuous observation of their browsing habits, allowing the development of specific profiles for displaying ads based on that behavior.

      If a user consents to the use of cookies, information on how to revoke consent and delete cookies must be readily and permanently available to them.
